(Course Description)

Bu derste cebri icra hukukuna giriş (cebri icra kavramı, ilamlı ve ilamsız takip ayrımı, külli icra - cüzi icra ayrımı, borçlu ve alacaklı terimleri), icra ve iflas hukukunda ceza sorumluluğu, icra hukukunun bölümleri, icra hukukunun kaynakları, icra teşkilatı, icra dairelerinin görev ve sorumlulukları, icra mahkemesi kararlarına karşı kanun yolları, şikayet, icra harç ve giderleri, icrada tebligat, süreler, tatil ve talik, icra takibinin tarafları, ilamsız icra kavramı ve ilamsız icrada görev ve yetki, genel haciz yolu ile ilamsız takip [takip talebi, ödeme emri, ödeme emrine itiraz, itirazın hükümden düşürülmesi (itirazın iptali davası - itirazın kesin kaldırılması- itirazın geçici kaldırılması - borçtan kurtulma davası), menfi tespit ve istirdat davaları, icra takibinin iptali, ertelenmesi ve zamanaşımı nedeni ile icranın geri bırakılması, mal beyanı, haciz, borcun taksitle ödenmesi, paraya çevirme aşaması, paraların ödenmesi aşaması ve aciz vesikası] konuları anlatılacaktır.

In this course the following topics will be covered: introduction to enforcement law (the term of enforcement, the separation of enforcement with/without court decision, the separation of enforcement law and bankruptcy law, the terms of debtor and creditor), criminal responsibility in compulsory enforcement law, the legal foundations of compulsory enforcement law, sources of compulsory enforcement law, organization of compulsory enforcement, duties and responsibilities of enforcement offices, appeal procedures for decisions of enforcement court, complaint, fees and expenses for compulsory enforcement proceedings, notification, terms, suspension and postponement of terms in compulsory enforcement proceedings, parties of compulsory enforcement proceedings, the term of enforcement proceedings without court decision, competence and venue in enforcement proceeding without court decision, general enforcement proceeding without court decision through foreclosure [request to enforcement proceeding, payment order, opposition to the payment order, dismission of opposition to the payment order (lawsuit for the annulment of the opposition, certain cancellation of the opposition, temporary cancellation of the opposition, lawsuit for temporary dismission of the opposition), negative declaratory action and action for restitution, cancellation and postponement of enforcement proceeding, suspension of enforcement proceeding due to statute of limitations, declaration of property, foreclosure, payment of the debt by installments, forced sale, payment and issuance of certificate of insolvency].

Dersin Amacı

(Course Objectives)

1. Sübjektif hakların devlet organları eliyle cebri icrasını öğrenmek.

2. İlamlı icra ile ilamsız icra ayrımını yapabilmek ve bu yolların detayını bilmek.

3. Cebri icra görevlilerini ve onların rol, hak ve sorumluluklarını anlamak.

1. Learning of the compulsory enforcement of subjective rights by state organs.

2. Distinguishing of enforcement proceedings with/without court decision and knowing the details of such proceedings.

3. Knowing the officers taking part in the enforcement proceedings and their rights and responsibilities.

Bu dersi başarı ile tamamlayan öğrenci

I. Cebri İcra Hukuku ile ilgili temel kavram ve kurumları örneklendirir.

II. Cebri İcra Hukuku alanında yargı kararlarını ve yasal düzenlemeleri karşılaştırır.

III. Bir icra takibinin taraflarının ve bütün ilgililerinin hak ve yetkilerini analiz eder.

IV. Bir takibin her aşamasında ortaya çıkabilecek uyuşmazlıkları tespit eder.

V. Cebri İcra Hukuku alanındaki yenilikleri ve değişimleri gerektiğinde mukayeseli hukuk çerçevesinde tahlil eder.

VI. Cebri İcra Hukuku alanında teorik görüşleri ve bu görüşlerin pratik sonuçlarını araştırır.

The student who successfully complete this course, will be able to

I. Exemplify the basic concepts and institutions related to Compulsory Enforcement Law.

II. Compare judicial decisions and legal regulations in the field of Compulsory Enforcement.

III. Analyze rights and powers of the parties of an enforcement proceeding and all other interested parties.

IV. Identify any conflicts in every stage of an enforcement proceeding.

V. Analyze innovations and changes in the field of Compulsory Enforcement Law within the scope of comparative law, if necessary.

VI. Investigate the theoretical opinions and their results in practice in the field of Compulsory Enforcement Law.
