(Course Description)

Bu derste tümevarım ve tümdengelim metotlarının kanıtlamada kullanılması, doğa bilimleri ve sosyal bilimler metot farklılıkları, mantık sisteminin temel ilkeleri (özdeşlik, değişmezlik - üçüncü halin olmazlığı), mantığın hukukta kullanımı, pozitif hukukun uygulanması, hukuk metodolojisinin sorunları: hukuki yargılar, hukuki yargılardan yargı kararlarına, gerekçelendirme ihtiyaç, hukuk metodolojisinin sorunları: gerekçelendirme zorunluluğu, hukuk kuralları ve hukuk normları, yaratıcı bir eylem olarak anlamlandırma/yorumlama anlatılacaktır.

Dersin Amacı

(Course Objectives)

Bilimsel metod ve araştırma teknikleri çerçevesinde soyut ve somut hukukî meseleleri doğru görme, anlama, değerlendirme ve çözme bilgi ve becerisi kazandırmaktır.

The aim of this course is to provide knowledge and skills to understand, evaluate and solve legal issues within the framework of scientific methods and research techniques.

Dersin Öğrenme Çıktıları

(Course Learning Outcomes)

Bu dersi başarı ile tamamlayan öğrenciler;

I-  Bilim kavramını tüm açılardan değerlendirebilecek, sosyal bilimlerin temel yöntemlerine vakıf olacaktır.

II- Hukuka ilişkin bilginin elde edilme süreçlerini anlayacak ve kullanma yetisini geliştirecek

III. Ana hatlarıyla yorum, boşluk doldurma, sistemleştirmeden oluşan 'pozitif hukukun uygulaması' sürecini kavrayarak temel hukuki yorum yöntemlerini kullanabilecektir.

Students who pass the course will able to:

I.   To evaluate the concept of science from all angles and be foundationfor the basic methods of social sciences.

II.  To understand the processes of obtaining knowledge of the law and improve its ability to use it.

III. To use basic legal interpretation methods by understanding the process of 'applying positive law' consisting of comments, filling spaces, systemization.
